Text messaging terms
These terms cover the Forty Medical Systems test messages program (the “program”). The program's text messages (SMS) are sent by Forty Medical Systems (40MS), a filed name of EMC Enterprises, LLC. 40MS uses the program to test the texting features of CEMS, its platform for medical wellness and aesthetic practices, before any Practice uses them.
Who the program is for
The program is only for 40MS staff and people 40MS has invited to test CEMS who ask to receive test messages. It is available for US mobile numbers only. It never texts a Practice's Patients, and it never sends marketing.
How you join
To join, email support@40medical.com from your own email address with your mobile number, asking to receive Forty Medical Systems test messages and saying you agree to these terms. 40MS keeps your email as the record of your consent. Joining is optional: you can test CEMS without receiving texts. After you join, the first message confirms that you are enrolled, says how often messages come, and tells you how to get help and how to opt out.
What messages you get
- Test messages that 40MS sends to check that texts are delivered.
- Sample service messages that show how CEMS texts look, such as an appointment confirmation, an appointment reminder, a payment receipt, or a reply in a message thread. They use made-up names and details, never real Patient information.
- Replies to messages you send to the program, including the replies to HELP and STOP.
Every message names Forty Medical Systems (or 40MS) as the sender. Messages come from a single 10-digit number registered to 40MS.
How often
Message frequency varies. You get messages only when 40MS runs a test that includes your number, or when you text the program and it replies.
Cost
Message and data rates may apply for any messages that we send to you or you send to us. 40MS does not charge for the program. Contact your wireless provider for questions about your text or data plan.
How to opt out
Reply STOP to any message at any time. CANCEL, END, QUIT, UNSUBSCRIBE, OPTOUT and REMOVE also work. You get one message confirming that you are unsubscribed, and no more messages after that. You can also opt out by email or phone at the contacts below. To join again, ask 40MS the way you did the first time.
How to get help
Reply HELP to any message. The reply names the program and gives the support contacts. You can also reach support at support@40medical.com or +1 (865) 312-0203.
Health information
The program is for testing only. Don't send health information or other sensitive details by text.
Delivery
Carriers are not liable for delayed or undelivered messages.
Privacy
Your mobile number and your consent to receive texts are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. 40MS uses them only to run the program. 40MS shares your number only with the companies that deliver the messages (Amazon Web Services and wireless carriers), and only to deliver them, or where the law requires it. Google, 40MS's email provider, stores the email you sent to join, only as the record of your consent.

Changes
If these terms change, 40MS updates this page and the date at the top. If a change affects what you receive, 40MS tells you before it applies.
